An unanswered constitutional question about the judicial branch involves
A) who should approve judges and justices.
B) what “good behavior” means, with regard to judicial terms.
C) how a Supreme Court is created.
D) who should appoint judges and justices.
Answer: B) what “good behavior” means, with regard to judicial terms.
An unsolved constitutional question concerning the judicial branch is the application of the “good behavior” terminology used for judicial terms. Pursuant to the U.S. Constitution, the federal judges are to serve “during good Behaviour.”
However, it is very difficult to say outright what “good behavior” is and whether it only means a crime, or if it is more than just one thing. Such lack of clarity has emerged as an area of disagreements on the basis for impeachment, and removal of the federal judges, as well the degree of judicial independence and accountability . The interpreting of this saying will have a real meaning to the judiciary’s position and its power among three branches of government.
